Terms and Conditions

You, the client, are engaging CUSSEN CO. PTY LTD. trading as Cussen Creative (ABN 62 695 699 891) to provide graphic design services including, but not limited to, branding, document design, corporate collateral and website design for the price outlined on our website (www.cussencreative.com.au) or within a proposed quote.

By accepting a quote, your contact details will be stored within Cussen Creative’s admin system. You may also be added to our mailing list, with the option to unsubscribe at any time.

Logo + Branding

Concepts

Cussen Creative will determine timeframes for initial design concepts based on current workload. Concepts will be supplied via email unless otherwise agreed.

Following feedback, revisions will be made to refine your selected concept. If initial concepts do not meet your requirements, one additional round of concepts may be provided at no additional cost.

Author’s Corrections

Author’s Corrections refer to changes made outside the originally approved brief or supplied content.

For example, if a business name or core content changes after design has commenced, this will be charged at $110.00 per hour + GST.

File Delivery

Once final designs are approved, files will be supplied in suitable formats for print and digital use (e.g. JPG, PNG, PDF, EPS).

Ownership

Upon full payment, you (the client) will own the final approved design for use across all relevant media.

Cussen Creative retains the right to display the work in portfolios, marketing materials and social media.

The client is responsible for any copyright, trademark or legal protection associated with the final design.

Payment

The client agrees to pay the full project fee as outlined in the quote.

All design work remains the property of Cussen Creative until payment is received in full.

If the agreement is terminated prior to completion, Cussen Creative reserves the right to invoice for all work completed up to that point.

Delays

Cussen Creative is not liable for delays caused by circumstances beyond reasonable control, including illness, technical issues or external events.

Performance Liability

Cussen Creative is not liable for any loss, damage or financial impact arising from the use of supplied designs.

All work is provided in good faith and based on the information supplied by the client.

Termination

The client may terminate the agreement if agreed deadlines are not met without reasonable cause.

If the project is terminated by the client after work has commenced, the client will be invoiced for all work completed to date.

Print + Corporate Collateral

This includes (but is not limited to) flyers, brochures, reports, posters, templates and other marketing or corporate materials.

Concepts & Revisions

Design concepts will be provided based on the agreed scope of work. Quotes include one round of revisions, unless otherwise specified.

Author’s Corrections

Changes outside of the original brief or supplied content will be charged at $110.00 per hour + GST.

To avoid additional charges, please ensure all content is final and approved before submission.

Ownership

Final approved designs are owned by the client once payment is received in full.

Cussen Creative retains the right to display work for portfolio and promotional purposes.

Stock Photography

Where required, a small number of stock images may be included. Licensing remains with Cussen Creative unless otherwise agreed.

Working Files & Templates

Working files are not included as standard.

If requested, they may be supplied at a flat rate of $660+GST for large documents and $330+GST for smaller media.

Cussen Creative is not responsible for any changes, errors or inconsistencies once working files are supplied.

Fonts are subject to licensing and will not be transferred if it breaches copyright.

Printing

Cussen Creative can assist with print management but is not responsible for issues arising from third-party printers or in-house printing.

Delays & Termination

Same conditions apply as outlined above.

Payment Schedule

A 50% deposit is required to commence work.

The remaining balance is due within 14 days of project completion.

For projects over $5,000, milestone payments may be required.

Once final payment has been received:

• The client owns the final approved deliverables

• Files will be supplied for print and digital use

• The client is responsible for storing files securely

Cussen Creative retains the right to showcase completed work within portfolios, website and social media.

Final Agreement

Before confirming your agreement, please ensure you have read and understood these terms.
